Terms of Service:

Effective April 20, 2023, these terms govern the following services provided by {m}othership milk including but not limited to the use of our website “mothership-milk.com”; account membership; the purchase of any of our products and/or packages; or any promotions.

General:

Our service allows customers to freeze-dry their own breast milk for long-term storage and preservation using technology that freeze-dries at very low temperatures below 40 degrees. By using our service, customers agree to provide only their own, personally expressed breastmilk for freeze-drying. We will handle and store customers' breastmilk in accordance with industry-standard sanitation and storage practices outlined on our FAQ page. We cannot guarantee the complete preservation of all nutrients and properties of the breastmilk during the freeze-drying process. Customers assume full responsibility for determining the suitability of the freeze-dried breastmilk for their own personal use. We will not be held liable for any adverse reactions or consequences resulting from the use of any freeze-dried breastmilk coming from our facility. Customers must follow the instructions provided to them for the proper storage and use of freeze-dried breastmilk. 

Processing Standards:

To ensure the highest levels of quality and safety, {m}othership milk will not process any breast milk that fails to meet the criteria for safe processing as determined by {m}othership milk. Our processing standards include, but are not limited to, the following criteria determined at {m}othership milk’s sole discretion:

1. The breastmilk is stored in approved milk storage bags;
2. The milk storage bags have no visible rips, tears, leaks; and
3. The breastmilk, at the time of receipt by Mothership Milk, is at a temperature of zero degrees Celsius (0°C) or below 32 degrees Fahrenheit (32°F)

If any of the customer’s breastmilk fails to meet the processing standards as outlined above, or cannot be freeze-dried for any other reason as determined by {m}othership milk, we will notify the customer and cancel the order immediately. {m}othership milk will immediately discard any unprocessed breast milk in compliance with all applicable laws, rules, and regulations.

Communications:

By creating an Account on mothershipmilk.com you agree to subscribe to newsletters, marketing or promotional materials, and other correspondence. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing help@mothership-milk.com.  

Order Cancellations:

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to product or service availability; errors in the description or price of the product or service; error in your order or any other reason.

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

Payments for services rendered are non-refundable and we are not responsible for any losses, damages, or delays during shipping. 

Terms and conditions are subject to change at any time without notice. By browsing mothershipmilk.com, logging in to access services on mothership-milk.com, or purchasing any packages/goods on mothership-milk.com, you acknowledge that you have read, understood, and agree to be legally bound by these terms of service. If you do not agree to any of these terms, please do not use the website or any of our services.

Refunds

At our {m}othership milk, ensuring the safety of our products is our foremost commitment. We also offer a 100% satisfaction guarantee. If you're unsatisfied with your purchase, for any reason, just inform us, and we'll promptly handle your refund request. To request a refund, kindly contact us at help@mothership-milk.com via email.

Order and delivery limitations:

When placing an order with {m}othership milk, it is important to provide accurate and complete delivery addresses, including any apartment or suite numbers, and to notify any third-party recipients, such as hotel staff or caregivers, of the expected delivery.

{m}othership milk uses UPS, a third-party delivery company, to facilitate the shipment of products and services. You are responsible for agreeing to and abiding by the terms and conditions of the Third Party Delivery Service.

For domestic deliveries, the Third Party Delivery Service is authorized to leave the package at your designated delivery address. Please note that there may be service limitations that apply to your order, and it is important to consult the Third Party Delivery Service's terms and conditions for the most up-to-date information about such limitations. Some potential service limitations for domestic deliveries may include: the unavailability of overnight and Saturday shipping, no deliveries on Sundays, potential unavailability on holidays, longer transit times for deliveries to some rural areas and cut-off times that may delay processing until the next service day.

It is your responsibility to be aware of and comply with the Third Party Delivery Service's capabilities, terms, and conditions when placing an order with {m}othership milk.

Packing frozen breastmilk:

You acknowledge that it is your responsibility to carefully read and review all packing instructions provided by {m}othership milk and we will not be held responsible for your misuse of provided shipping materials or instructions.

In order to maintain a safe temperature when shipping frozen breast milk, you are responsible for ensuring the appropriateness of your FDA approved breast milk storage bags (please note that milk storage bags with screw-tops may not fit), that the milk storage bags are not filled beyond the ounce per bag capacity and are completely sealed, that your breast milk is frozen solid before packing, that the cooler lid fits flush, that you properly close and seal the cardboard box and affix the overnight shipping label over the old label.

It is your sole responsibility to ensure the proper and safe (i) washing of breast pump supplies, (ii) packaging and sealing of your breast milk, and (iii)  freezing of your breast milk.

Content

This website contains content that is either owned by {m}othership milk or used with their permission. You are strictly prohibited from distributing, modifying, transmitting, reusing, downloading, reposting, copying, or utilizing this content, in whole or in part, for commercial purposes or personal gain without our express advance written permission.

Prohibited Uses

By ordering the {m}othership milk Service, Customers represent and agree that:

1. Customer will not use the {m}othership milk Service in any way that violates any applicable local, national, or international law or regulation;
2. Customer will not use the {m}othership milk Service for the purpose of exploiting, harming, or attempting to exploit or harm minors in any way;
3. Customer will only use the {m}othership milk Service for personal use, such as to provide milk to Customer’s own child (which includes surrogated or adopted children);
4. Customer will not use the {m}othership milk Service for any illegal selling, swapping or donating of your powdered breast milk;
5. Customer is of the age of majority in Customer’s jurisdiction, has the power to enter into binding contracts, and is not barred from doing so;
6. Customer will not use the {m}othership milk Service to engage in any commercial activities, including, without limitation, acting as an intermediary to provide the {m}othership milk Service to third parties; and
7. Customer will not otherwise attempt to interfere with the proper working of {m}othership milk Service.

If {m}othership milk has reason to believe that Customer engaged in a Prohibited Use or otherwise violated these terms, {m}othership milk reserves the right to notify the proper authorities and any affected parties, as applicable, of the actual or potential breach. 

Accounts

By creating an account on {m}othership milk, you acknowledge and guarantee that you are at least 18 years of age, and that all information you provide us is true, accurate, complete, and current at all times. Failure to provide accurate, complete, or current information may result in the immediate termination of your account.

You are solely responsible for maintaining the confidentiality of your account and password, including limiting access to your computer and/or account. You agree to accept liability for all activities or actions taken under your account and/or password, whether authorized by you or not. If you suspect any unauthorized use of your account or a security breach, please notify us immediately.

You may not select as your username the name of another person or entity, a name that is not legally available for use, or a name or trademark that belongs to another person or entity without proper authorization. Offensive, vulgar, or obscene usernames are also not permitted.

We reserve the right to decline service, terminate accounts, modify or delete content, or cancel orders at our sole discretion.

Our website may provide links to third-party websites or services not controlled or owned by {m}othership milk. We assume no responsibility for their content, privacy policies, or practices and do not guarantee the offerings of these entities or individuals. {m}othership milk shall not be liable for any damage or loss resulting from or allegedly caused by using or relying on any content, goods, or services offered on or through any third-party websites or services. Please read the terms of service and privacy policies of any third-party websites or services you visit.

Disclaimer Of Warranty

Customer, not {m}othership milk, is solely responsible for safe (I) washing of breast pump supplies and (ii) packaging/sealing breast milk. Follow safe handling guidelines, including no re-freezing of thawed breast milk. {m}othership milk isn’t liable for damages/incidents related to shipping frozen breast milk.  Customer accepts risk of loss due to omission/failure to follow terms. Use {m}othership milk service at your own risk. {m}othership milk strives to accurately display services, products, and information, but not liable for any technical, typographical, or pricing errors.

By using {m}othership milk products and services, you acknowledge and accept that you assume all risk of loss. You also waive your right to seek a refund in the event that your actions or omissions, including but not limited to your failure to properly use and pack the cooler, your failure to properly seal the breast milk bags, your failure to provide accurate addresses and contact information, your failure to properly hand off your packages to the third-party delivery service, or your failure to comply with these Terms of Use, cause (i) the malfunctioning of the cooler, (ii) a misdelivery or misplacement of your shipment, or (iii) a delay in your shipment

Except as expressly set forth in these Terms and Coditions, we do not make any warranties or representations about the website, the products, the services, the vendor offerings, the quality of the breast milk, the breast milk storage bags, the coolers, any other materials provided in or with the packaging, the performance of the coolers, or the content, trademarks, service descriptions, and product descriptions on the website.

Limitation Of Liability

Consult a healthcare specialist before ordering {m}othership milk. Actual packaging may differ from website. Customer must read labels and directions before using. {m}othership milk complies with all applicable regulations, but cannot guarantee safety if the risk comes from circumstances beyond their control. Customer indemnifies {m}othership milk and affiliates from claims, damages, costs, and expenses arising from breach of terms.

Governing Law

The laws of the State of Michigan shall govern any dispute arising from or related to these Terms, without regard to conflicts of law principles. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. These Terms constitute the entire agreement between us and supersede any prior agreements or understandings regarding our Service.

Amendments To Terms

We reserve the right to modify these Terms of Service at any time without prior notice. Any changes made to these Terms will be effective immediately upon posting on the Platform. You are responsible for reviewing these Terms regularly to stay informed of any updates or revisions. Your continued use of the Service after any modifications to these Terms constitutes your acceptance of such changes. If you do not agree to the updated Terms, you must immediately discontinue use of the Service.

When utilizing our service or other services we provide, you acknowledge that you have reviewed and understood these Terms of Service, and you consent to be legally bound by them.
